GENERAL TERMS OF SALE AND TERMS OF SERVICE

These terms govern the use of peppercap.it and every purchase made through it. We wrote them to be complete, without the fluff. Please read them before ordering: by placing an order you confirm that you have read and accepted them.

1. WHO WE ARE (THE SELLER)
The website peppercap.it and the products sold on it are operated by:

Hereinafter: "PepperCap", "we" or "the Seller".

2. SCOPE
2.1 These terms apply to all distance sales contracts concluded through peppercap.it between the Seller and the buyer ("Customer").
2.2 The website is mainly aimed at consumers, meaning natural persons buying for purposes outside their trade, business, craft or profession (art. 3 of Italian Legislative Decree no. 206 of 6 September 2005, the "Consumer Code"). The rules the Consumer Code reserves for consumers apply only to Customers who are consumers.
2.3 The contract is governed by these terms, in the version published on the website when the order is placed, and by the following policies, which form an integral part of them: Shipping Policy, Withdrawal, Returns and Refunds Policy, Privacy and Cookie Policy. All of them are available at any time in the website footer under "Terms and Policies".
2.4 No different terms proposed by the Customer apply unless we agree to them in writing.
2.5 These terms are available in Italian and English. The contract can be concluded in either language. In case of conflict between the two versions, the Italian version prevails.

3. USE OF THE WEBSITE AND ACCOUNTS
3.1 To buy, you must be at least 18 years old and able to enter into contracts. If you are under 18, you may only buy with the involvement of a parent or legal guardian.
3.2 You can buy with or without an account. If you create an account, you are responsible for keeping your login details confidential and for all activity carried out with them.
3.3 You agree to provide true, complete and up-to-date information, especially your name, email and delivery address. We are not responsible for delays or failed deliveries caused by incorrect information provided by the Customer.
3.4 You must not use the website for unlawful purposes, to send offensive or harmful content, to attempt unauthorised access to our systems, or to collect other users' data.

4. THE PRODUCTS
4.1 We sell unstructured washed-cotton caps (dad hats) with an adjustable closure, and bundles of them. The main features of each product (material, size, colours, fit, care instructions, price) are shown on its product page.
4.2 Our products are designed by PepperCap. Every order ships from Italy.
4.3 We do our best to make photos and colours match the real product. Small differences in shade caused by your screen, device settings or the washed treatment of the fabric (which makes every piece slightly different) are not defects.
4.4 Availability shown on the website refers to the moment you view it. If a product turns out to be unavailable after you order, we will email you and, at your choice, you can wait for the restock or receive a refund of the amount paid within 14 days.

5. PRICES
5.1 Prices are in euros (€) and are final prices.
5.2 PepperCap operates under the Italian flat-rate scheme: sales are made without charging VAT pursuant to art. 1, paragraphs 54-89, of Italian Law no. 190/2014. No tax is added to the price.
5.3 Shipping costs are set out in the Shipping Policy and are always shown in the checkout summary before you confirm the order. There are no customs duties for deliveries to Italy and other European Union countries.
5.4 Discounts and promotions apply under the conditions and for the periods stated. When we show a price reduction, the previous price shown is the lowest price applied in the 30 days before the reduction (art. 17-bis of the Consumer Code).
5.5 If a price contains an obvious and recognisable error (for example €2.50 instead of €25.00), we will contact you before shipping: you can confirm the order at the correct price or cancel it for a full refund.

6. HOW THE CONTRACT IS CONCLUDED
6.1 Product pages are not binding offers but an invitation to place an order.
6.2 To order: choose the products and variant, add them to the cart, go to checkout, enter your contact and delivery details, choose the shipping and payment method, review the summary and press the final payment button (for example "Pay now"), which involves an obligation to pay.
6.3 Before pressing the final button you can always check and correct the information entered, by going back to the previous steps or editing the cart.
6.4 The contract is concluded when we send the order confirmation email to the address you provided. The email summarises products, prices, shipping costs and delivery address, and contains a link to these terms and policies, which you can save and print. The contract is stored in our systems and you can request a copy at support@peppercap.it.
6.5 We may refuse an order only for legitimate reasons, such as a well-founded suspicion of fraud, invalid payment details or a delivery address outside the countries we ship to. In these cases we charge nothing or immediately refund any amount paid.

7. PAYMENT
7.1 We accept the payment methods shown at checkout, including credit and debit cards (Visa, Mastercard, Maestro, American Express), Apple Pay, Google Pay, Shop Pay and PayPal. Available methods may vary by country and device.
7.2 Payments are processed by certified providers (Shopify Payments and PayPal). We do not see or store your full card details.
7.3 The amount is charged when the order is placed.
7.4 After ordering, you receive the receipt by email. As we operate under the flat-rate scheme, no VAT is shown.

8. SHIPPING AND DELIVERY
8.1 We ship to Italy and to the European Union countries listed in the Shipping Policy, with tracked courier. Times, costs and destinations are set out in the Shipping Policy.
8.2 Delivery times are estimates and run from the order confirmation. In any case, we deliver within 30 days of the conclusion of the contract (art. 61 of the Consumer Code). If we do not, you can set us an appropriate additional deadline; if that also expires, you can terminate the contract and receive a full refund within 14 days.
8.3 The risk of loss of or damage to the products passes to you only when you, or a third party indicated by you other than the carrier, take physical possession of the parcel (art. 63 of the Consumer Code). Until then, loss and damage in transit are our responsibility.
8.4 On delivery, check that the parcel is intact. If it is visibly damaged, accept it "with reservation" stating the reason to the courier, or write to us within a few days with a photo. This helps us handle the claim with the courier but does not reduce your legal rights.

9. RIGHT OF WITHDRAWAL (RETURNS)
9.1 By law, if you are a consumer, you can withdraw from the contract within 14 days of delivery without giving any reason (arts. 52-59 of the Consumer Code). PepperCap voluntarily extends this period to 30 days from delivery.
9.2 All return shipping costs are paid by us. We refund the full amount paid, including the original delivery costs, within 14 days of receiving your withdrawal notice. We may withhold the refund until we receive the product back, or proof that you have shipped it.
9.3 The right of withdrawal does not apply to goods made to measure or clearly personalised at your request (art. 59(c) of the Consumer Code). Gift cards are covered by section 10.
9.4 How to withdraw and the applicable conditions are set out in the Withdrawal, Returns and Refunds Policy, which forms part of these terms.

10. GIFT CARDS
10.1 If you buy a gift card, you receive by email a code to use on peppercap.it to pay for all or part of an order. Its validity is shown on the gift card and in the delivery email.
10.2 Gift cards cannot be exchanged for cash and do not give change. Any remaining balance stays available for future purchases until the expiry date.
10.3 You can withdraw from the purchase of a gift card within 14 days of purchase, provided it has not been used, even partially. After any use, even partial, or after this period, gift cards are non-refundable.
10.4 Products bought with a gift card follow the normal withdrawal rules: if you return them, the amount paid with the gift card is credited back to the gift card, unless you ask otherwise.
10.5 Keep the code safe: anyone who has it can use it. If the code is lost or stolen we cannot refund it, but we will gladly help if you can prove the purchase and the balance has not yet been used.

11. LEGAL GUARANTEE OF CONFORMITY
11.1 All products are covered by the legal guarantee of conformity under arts. 128 et seq. of the Consumer Code. We are liable for any lack of conformity that becomes apparent within 2 years of delivery.
11.2 To claim under the guarantee, write to support@peppercap.it describing the defect, ideally with a photo, within 2 months of discovering it.
11.3 In case of a defect you are entitled, free of charge, to repair or replacement. If these remedies are impossible or are not carried out within a reasonable time, you are entitled to a price reduction or to terminate the contract with a refund. All shipping costs related to the guarantee are paid by us.
11.4 The guarantee does not cover normal wear and tear or damage caused by misuse or by not following the care instructions shown on the website (for example high-temperature washing or tumble drying). The worn-in look and slight irregularities of washed fabric are intended features of the product, not defects.
11.5 The legal guarantee is in addition to any other rights you have by law and cannot be excluded or limited.

12. REVIEWS
12.1 We only publish reviews from customers who have bought our products. They come from two sources:
a) reviews collected through the Judge.me service via the personal link we email you after an order on peppercap.it: they are linked to the order and marked "verified purchase";
b) reviews customers left us after buying our products through our other online sales channels. They are not linked to an order on peppercap.it, so they don't carry the "verified purchase" mark; on those channels, however, a review can only be left by someone who has completed a purchase, so each one matches a real sale. We show them in their original wording, with the rating, the date and the author's shortened name (first name and last initial). We don't choose them based on their rating: positive and negative reviews are published on the same terms.
If we receive a review that doesn't match a purchase made from us, on the website or on our other channels, we don't publish it or we take it down.
12.2 Some reviews are translated by us into Italian or English without changing their meaning. We are happy to show you the original text on request.
12.3 We do not pay for reviews and we do not offer discounts, gifts or any other benefit in exchange for a review. We do not publish reviews written by us or by people who have not bought from us. Negative reviews are published on the same terms as positive ones: we only remove content that is offensive, unlawful, contains other people's personal data or is unrelated to the products or our service.
12.4 If you think a review breaks these rules, or you want your own review removed, write to support@peppercap.it.
12.5 This information is provided pursuant to art. 22 of the Italian Consumer Code, as amended by Legislative Decree no. 26 of 7 March 2023.

13. INTELLECTUAL PROPERTY
13.1 The PepperCap name and brand, logo, embroidery designs, texts, photos, graphics and all other website content belong to PepperCap or their respective owners and are protected by copyright and industrial property laws.
13.2 You may browse the website for personal use. You may not copy, reproduce, modify, distribute or use the content for commercial purposes without our written permission.

14. LIABILITY
14.1 We are liable to you under Italian law. Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, personal injury, damage caused by defective products (arts. 114 et seq. of the Consumer Code), or rights that the law grants consumers on a mandatory basis.
14.2 Outside these cases, we are not liable for damage arising from temporary interruptions of the website due to maintenance, failures of technical service providers or force majeure, nor for use of the website in breach of these terms.
14.3 The website may contain links to third-party sites (for example social networks). We do not control those sites and are not responsible for their content.

15. FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control (for example courier strikes, natural events, orders of public authorities). In such cases we will notify you promptly and, if the delay exceeds the legal deadlines, you may withdraw from the contract with a full refund.

16. PERSONAL DATA
We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003, as described in the Privacy and Cookie Policy.

17. GOVERNING LAW, JURISDICTION AND COMPLAINTS
17.1 The contract is governed by Italian law. If you are a consumer resident in another European Union country, you keep the protection of the mandatory rules of your country of residence (art. 6 of Regulation (EC) no. 593/2008).
17.2 For disputes with a consumer resident in Italy, the court of the consumer's place of residence or domicile has exclusive jurisdiction (art. 66-bis of the Consumer Code).
17.3 For any complaint, write to support@peppercap.it or by certified email (PEC) to giuseppe.scalioti@pec.it. We reply within 7 working days.
17.4 If the complaint is not resolved, you can contact an alternative dispute resolution (ADR) body listed under art. 141-decies of the Consumer Code. PepperCap is not required to use a specific ADR body but will consider any proposal in good faith. Your right to go to the competent court is not affected.

18. CHANGES TO THESE TERMS
We may update these terms, for example to comply with new laws. Each order is governed by the version published on the website when the order is placed. The date of the last update is shown at the top.

19. SEVERABILITY
If any clause of these terms is found to be void or ineffective, the other clauses remain valid.
